The holder of all rights on the website beauty-garden.hr is the company RONDO MONDO d.o.o. (hereinafter: Rondo Mondo). Rondo Mondo provides a sales service via its service - beauty-garden.hr internet store (hereinafter referred to as: Beauty-Garden) through the above-mentioned website. By using the Beauty-Garden service and all associated pages and services on the beauty-garden.hr domain, it is considered that consumers are at all times familiar with these Terms of Sale (hereinafter: Terms), and that they fully understand and accept them. These Terms apply to the rights and obligations related to the purchase of products or services through Beauty-Garden and the rights and obligations arising from the conclusion of the Distance Sales Agreement (hereinafter: the Agreement) between the consumer as the end customer and Beauty-Garden, are considered an integral part of such contracts.

- TERMS OF SALE
- I) Conclusion and termination of the sales contract
These Terms and Conditions as well as individual terms of sale indicated with information about specific products represent Rondo Mondo's offer to conclude a Contract, and the user as a customer by registering, concluding an order or in another way established by these Terms and Conditions accepts them, which is considered to have concluded a Contract between the user and Rondo Mondo , and according to the conditions of sale specified in these Terms.
The subject and commercial purpose of the Agreement is the purchase of a selected product or service through Beauty-Garden upon payment of the appropriate fee - the price of that product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed advertising messages with purchase order, telephone with and without human intervention, and the Internet.
The contract comes into force and is binding from the moment the user accepts Rondo Mondo's offer in one of the following ways:
- by selecting payment and completing the order as a registered user of Beauty-Garden
• by selecting payment and completing the order via 01/8877-615
- a) In the process of registering or creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required to register or create a user account must be true, and the use or use of other people's data is expressly prohibited.
- b) Registration or user account is created only for one person and it is not allowed to communicate information about registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else's registration or user account is not allowed.
- c) For violation of the provisions of the Terms and Conditions from this chapter, Rondo Mondo reserves the right, at its discretion, to terminate the user's registration or user account, without the obligation to compensate the user for any cost or damage.
- d) Registration (which includes payment for the service) is considered to have concluded a Contract between Rondo Mondo and the user as a customer.
- e) The Agreement enters into force upon the user's registration, i.e. from the day the user accepts the offer to enter into such an Agreement.
- f) On the occasion of the conclusion of the Agreement, the user will be delivered: a confirmation of the concluded Agreement, i.e. a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Terms and Conditions, and a notice of the user's right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.
- g) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. The User does not have the right to unilaterally terminate the Agreement:
- if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
- if the subject of the Agreement is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,
- if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery,
In order for the user to be able to exercise the right to unilaterally terminate the Agreement, he must notify Rondo Mondo of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by post (to RONDO MONDO d.o.o., Zagrebačka cesta 212, 10000 Zagreb), by fax to 01/8877 -608 or by email at info@beauty-garden.hr , in which you will state your first and last name, address, telephone number, fax number or e-mail address, and you can also use the specified written form for unilateral termination of the Agreement.
Also, the user can fill out and send the Form for unilateral termination of the Agreement electronically, in which case Rondo Mondo will send him a confirmation of receipt of the notice of unilateral termination of the Agreement by electronic mail without delay.
The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and no later than within 14 (fourteen) days from the day when Rondo Mondo, i.e. Beauty-Garden receives the user's decision to unilateral termination of the Agreement, unless the user has chosen another type of delivery, which is not the cheapest standard delivery offered. The refund will be made in the same way the user made the payment. In the event that the user agrees to another way of returning the paid amount, he does not bear any costs in relation to the return. Rondo Mondo can issue a refund only after the goods have been returned or after proof that the goods have been sent back has been provided.
The user is obliged to hand over the goods or send them to the address RONDO MONDO d.o.o., Zagrebačka cesta 212, 10000 Zagreb, without undue delay, and in any case no later than within 14 (fourteen) days from the day when Rondo Mondo or Beauty-Garden , sent his decision on the unilateral termination of the Agreement. The direct costs of returning the goods must be borne by the user himself. The user is asked to call 01/8877-626 or contact info@beauty-garden.hr before terminating the Agreement so that the procedure for returning the goods can be explained to him.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user's request, the execution of the service began during the term for unilateral termination of the Agreement, the user is obliged to pay Rondo Mondo an amount commensurate with what was delivered by the time the user informed Rondo Mondo of the unilateral termination of the Agreement.

- II) Conditions and procedure for purchase
The main characteristics of the product, the method of use, prices, special offers and benefits, payment and delivery methods refer to those that are valid at the time the order is placed. The above data will be indicated with each product.
The price of the product, which includes the amount of VAT and the cost of delivery, is visible in the shopping cart before the order is placed. The cost of delivery may also be visible on some other parts of the page. All information about the purchase confirmation based on the electronic order will be delivered to the customer's e-mail address specified in the registration/order process or in the shopping cart when entering data when concluding the order. All prices are expressed in Croatian kuna (HRK). All prices include VAT.
If the customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. III) Delivery and delivery conditions

the shipping cost is calculated automatically when you purchase the product and you are issued an invoice with the price of the purchased products and the shipping price
• the cost of delivery will be shown in the shopping cart along with the price of the product
• the cost of delivery in the territory of the Republic of Croatia is taxed and amounts to HRK 40, regardless of the weight, volume or customer's address
• the delivery term for products, which are stated to be in stock, throughout Croatia is 10-14 days from the day of the order, except for products with a special note
• in the case of application of the delivery deadline or any other important circumstances for the execution of the order, the customer will be informed immediately by our customer service
- IV) Complaints and Objections
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the packaging of the shipment when taking it over. If the packaging of the shipment has visible damage/flaws, we recommend that the customer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By rejecting the receipt, the delivery service will return the shipment to Rondo Mondo, noting that the shipment contains a defect.

In the case of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or product replacement. If it is a question of damage and/or malfunction of the delivered goods, the buyer should send a photo of the said complaint so that it can be accepted on the basis of physical evidence. Beauty-Garden collects the advertised damaged, defective or wrongly delivered goods at its own expense, if it is determined that the complaint is justified and that the customer did not affect the defectiveness, damage or any lack of the goods. In the event of a justified complaint, the cost of replacing the product with a new one is entirely borne by Beauty-Garden.
In the event of a dispute regarding the justification of the complaint and/or the manner in which the product was returned (the product must be unused, in an unchanged quantity and in the original packaging, with the original invoice and warranty presented, if any) the product will be submitted for expert examination by an expert or an expert legal entity . In the event that the expert opinion determines the justification of the complaint, all the cost of replacing the product will be borne by Beauty-Garden, and in the case of an unjustified complaint, the cost will be borne by the customer.
- V) Warranty for the correctness of the sold products and service
Products for which we provide a guarantee in accordance with the law and the guarantee specified by the manufacturer have a guarantee certificate. The right to use the warranty is realized upon presentation of the invoice and warranty card. The customer is obliged to keep the warranty card and receipt. The date of issue of the invoice is the date of activation of the guarantee. Along with the product description, there is information about the period for which the warranty is provided for a specific product.
In case of issuing a warranty certificate by which the manufacturer guarantees the correctness of the product during a certain period of time, the customer can, if the product is not correct, demand that the product be repaired within a reasonable period of time, or that another such correct product be handed over to him instead of repair. If the product malfunctions during the warranty period, it must be delivered to the authorized service center specified in the warranty card.
The right to use the guarantee is exercised only upon presentation of the invoice. The customer is obliged to keep the warranty card and receipt. Product malfunction resulting from improper use and/or non-compliance with the instructions is not covered by the warranty. Servicing and sale of replacement parts for the purchased product is provided through the authorized repairers listed in the warranty card.
The warranty does not exclude the seller's responsibility for material defects of the product.
The deadline for complaints in case of material product defects is 2 years.
- VI) Method and procedure of payment
Payment of the product price and delivery costs can be made in one of the following ways:
- a) Payment by advance invoice (only for legal entities). Legal entities have the option of paying by advance invoice. After confirming the order, Beauty-Gardena sends a proforma invoice to the customer's e-mail address. After receiving the payment in accordance with the estimate, the delivery process is started.
- b) Cash payment - cash on delivery. When picking up the shipment, the full amount indicated in the invoice is paid to the delivery person, including the cost of delivery.
- DATA PROTECTION WHEN PURCHASING
Beauty-Garden undertakes to respect the anonymity and privacy of Beauty-Garden users and will use and process data exclusively for the purpose and purpose specified in these Terms. Beauty-Garden can collect personal data of the user, such as name, address, OIB, telephone number or e-mail address only if the user voluntarily provides them to Beauty-Garden.
Beauty-Garden reserves the right to contact customers via e-mail to inform them about promotions and discounts related to the order they placed on the beauty-garden.hr web store. Every customer can cancel receiving the newsletter at any time by clicking on the "Unsubscribe" link in the e-mail or by sending a request to info@beauty-garden.hr.
Beauty-Garden will use the said data exclusively for the purpose of fulfilling contractual obligations and better insight and understanding of the individual needs, habits and demands of users, as well as further development and better provision of all Beauty-Garden services. Beauty-Garden collects, processes and publishes data about users related to the way Beauty-Garden is used without revealing the user's identity and/or personal data that enable the user's identity to be revealed.
Beauty-Garden collects and records data about the user's IP address (Internet Protocol Address) or about the location of the computer for the purposes of system administration, troubleshooting, content download confirmation or improvement of technical aspects of the Internet service. Beauty-Garden will automatically record data on the user's usage habits of Beauty-Garden, including a log file on visits to certain pages and/or content. Such data will be used by Beauty-Garden exclusively for the purpose of improving its service and adapting and individualizing promotional activities according to the needs of individual users.
- BEAUTY-GARDEN'S COMMUNICATION WITH USERS
By registering, you agree that Beauty-Garden, for the purpose of promoting services and products, may notify you by e-mail about changes or additions to content on the pages, discounts, promotions, products or changes in the way the service is provided. The user can revoke the given consent at any time.
ALTERNATIVE RESOLUTION OF CONSUMER DISPUTES (ARSP)
